址台中李姓男子日花4500元租一輛名車，卻因李男在國道3號飆速190公里，遭吊扣牌照6個月，導致租車公司嚴重損失。租車公司決定以半年營業損失對李求償81萬元，李男則認為，租車公司隱瞞資訊，反控對方是詐騙。法院根據雙方事後和解的協議書內容，判處李男應賠償公司36萬元，可上訴。

因為李男租車在國道飆速，導致汽車牌遭到吊扣，租賃公司不堪損失，轉而向李男求償。租車公司主張，李男去年10月22日和他們簽約租車，約定每天租金4500元，該租約第4條也明定若承租人遭主管機關站扣牌照，應由承租人負擔牌照被扣期間內之租金。並表示，李男開車上國道因時速190公里嚴重超速，遭台中市交通裁決處裁罰吊扣牌照6個月，決定依6個月不能營業損失的租金為81萬元，扣除李已給付4萬元，對他求償剩餘的77萬元。
李男以書狀抗辯稱，租車公司原本可以租用車為由申請免扣牌照，但卻隱瞞此情逼他簽立車輛吊牌協議書，認為對方是詐騙行為。

址法院查詢李男簽訂的租約有這條「如違反道交條例第43條，牌照、行照或車輛被主關機關暫扣，期間租金由承租人負擔」，租車公司可依照合約向李男賠償損失。法院也發現，李男超速後同年11月20日曾和租車公司簽立協議書，協議以理賠金40萬5000元和解。由於李男已經支付4萬元，法院認為租車公司求償剩餘部分有理由，判決李男應給付對方36萬5000元，可上訴。
